The Importance of a Lasting Power of Attorney (LPA)

A Lasting Power of Attorney (LPA) is an essential legal document that allows you to appoint someone you trust to make decisions on your behalf if you lose the mental capacity to do so yourself. This could relate to decisions about your finances or your health and welfare. Without an LPA in place, your loved ones may face difficulties and delays in managing your affairs, as well as potential legal complications. Setting up an LPA provides peace of mind, knowing that the person you choose will be able to make decisions for you if needed.

Timeframe for Creating Your LPA

Once you have made payment, we will begin by gathering the necessary information. This includes details about the Donor (the person making the LPA), the Attorney(s) you are appointing to act on your behalf, a Certificate Provider who will confirm your capacity to make the LPA, and the Witnesses who will sign the documents.

After all the required information has been provided, it will take around two working days for us to draft your LPA documents. Once the documents are ready, you can choose to either download and print them or have them sent to you by post.

We will then arrange a call to guide you through the signing process, ensuring that the documents are signed correctly by all parties, including the Donor, Attorney(s), and Witnesses. This is a crucial step to avoid any delays or issues with the registration of the LPA.

After signing, you will need to send the completed LPA documents to the Office of the Public Guardian for registration. At this point, you will also need to pay a fee of £82 per LPA to the Office of the Public Guardian. Once the LPA is registered, it will be officially in place, ensuring that your affairs can be managed according to your wishes if you are ever unable to do so yourself.

The Office of the Public Guardian (OPG) typically takes 8 to 10 weeks to review and register a Lasting Power of Attorney (LPA), provided there are no errors or issues with the application. This time frame includes their review process to ensure that the LPA has been correctly signed and witnessed. If there are any mistakes or additional information required, the process may take longer. Therefore, it’s crucial to ensure that the documents are completed correctly to avoid delays.
